If I make a citizen's arrest of someone, and he is not proven guilty, can he sue me for false arrest?

What are the consequences of a non-policeman making a citizen's arrest, if he/she is not subsequently proven guilty?If I make a citizen's arrest of someone, and he is not proven guilty, can he sue me for false arrest?
Got some answers here that are very likely mistaken, but it's difficult to tell for sure because you didn't say what state you're in.





Just the same, people are found not guilty all the time of charges they have been arrested for and it does not mean there was a false arrest. It's an argument to be used, yes, but just being found not guilty does not equal a false arrest.If I make a citizen's arrest of someone, and he is not proven guilty, can he sue me for false arrest?
If it was me,being sued would be the least of your problems.
your not accually arresting the person, you are detaining them until the police arrive. if the detention was reasonable then you are protected. but if not, you may be in trouble
Yes, being that your arrest was not lawful. In most states one of the criteria for making a citizens arrest is that you have to know in fact that a crime has been committed and know the person you arrested had in fact committed that crime. The burden is less on police as usually they have to believe a crime has been committed and have probable cause the person they arrested commuted the crime.
the ONLY time you can make a citizens arrest is when you see a FELONY happen , other then that your going to be arrested for unlawful restraint , disorderly conduct , and false imprisonment . remember you are not a police officer . if someone needs arrested pick up the phone and call 911
Try unlawful restraint, battery, etc..
