That's BS. Even if a restaurant charges a ';mandatory'; gratuity based on number of diners at a table, it's always contestable if the service was horrible. A gratuity is a gratuity. I know I saw that on the news like 20 minutes ago. Tipping is always optional and is based on the service. They received horrible service, the waiter does not deserve a tip. There should not have been an arrest made. At the same time I don't know if suing over this is worth it. But at least it will make a point.





Oh and that article is wrong, the gratuity percent came out to almost 22%, not 18%. I totally agree with them not paying it.
They agreed to the bad service by waiting an hour for service, going to get refills, napkins and silverware on their own.


They will make money off this my friend and the business will get a black eye on their restaurant policy's.


I bet the manager is being fired as we speak if not already.

Yes. Tips are not required by law. 18% is also a little steep. Most people only pay 15% for good service, and 10% for average service. Since the gratuity is included in the bill, it means that the servers can provide whatever kind of service they want and still expect to get their 18%. That's unfair. The manager also said that they had to wait unusually long so that's a good enough reason to not pay the tip.
I know i seen that story the other night on my local news. I live in the area

Their employers should be paying them a good wage in the first place.
