False arrest?

I had a verbal arguement with my kids mom, the neighbor called the police. I was inside my house , had few beers when the cops arrived they said whats going on. I told them we were arguing and I told the told the police that I don't wanna talk to u guys anymore. They asked my kids mom that if I touched her which she said no. They arressted me saying that I was drunk in public which I was in my front yard. When I looked at their computer, the officer put down ';domestic verbal abuse'; and '; I was breaking things in the house'; which was not true. I spent a night in jail. They never tested me for alchol. Also she was being a ********* with on her way to jail. My question is ';Can I sue her and the police department.'; She was definately abusing her power. When i was released from the jail they never gave any paper that if i have to go to court.False arrest?
I think there is a very good chance that there was Probable Cause to arrest you. Just because formal charges were never filed does not make the arrest unlawful.

your innocence. The person (who is married) has been lying to everyone, and has put in a false report saying I have been causing him extreme emotional harm by trying to kill myself because he wont come back to me, and that I tried to kill myself by putting my head through a plate glass window etc. None of that is true. I will admit to flirting with this guy when I go to the local pub where he is a DJ, but that is all. A few weeks ago I was drunk and played with his butt for about a minute when he hugged me goodbye, and he was rubbing my back while I did. Not once has this guy ever asked me to stay away from him, even though I asked him when I heard through a friend, he said it wasn't true. His wife was the one who has been harrassing me, and I have not responded to her insults, nasty emails, texts, and myspace blogs. I would like to be able to prove the allegations are false, but don't want to have to be arrested, which appears to be the only way I can get the caution removed. This woman called the police and reported that you were stalking her. SO? Have you been arrested for stalking? Probably not. Until you are arrested for stalking, there is nothing for you to worry about. But since you have harassing electronic correspondence from HER, you have legal grounds for a protection order against HER! Go to your local magistrate's office and obtain a temporary protective order against this woman.Is it possible to prove that a police report for stalking is false, without having to be arrested to prove?
You have proof that you are being harassed. you have a right to your right to be heard. slap this woman with a protection order on her, then slap a slander suit on her.

Can anyone cite a law that prohibits giving a false birth date and/or SS# on a fingerprint card when arrested?

I know a guy who gave a false birthdate and social security number when he got arrested and fingerprinted. He got away with it. ....or at least he thinks he did for now. Does anyone know of a Federal law that covers this? Assuming the fingerprints were put into the FBI database, I would think there has to be some federal statute prohibitting it. ....or a state law in Arkansas. If the info he gave belongs to someone else, it's Identity Theft. If not, it doesn't matter, because the next time he gets arrested and uses something different, they will just add the new things he uses on as Aliases. It will all get kept in a file linked by his fingerprints.
I don't know of a federal law, but here it would be FALSE PERSONATION.
Though I can't be specific it would probably be located under identity fraud. Or falsifying information.
giving false info to the police is a crime by itself even if u are stopped and give them a false name let alone on a fingerprint card, and what u describe is very against the law. my advice would be to try and talk to an officer and let them know so they can haul him in and get it right , he could get away with any number of crimes doing this and not pay the consequences as a lot of criminals are caught during a common traffic stop and if they dont have the right name to go with a fingerprint card the warrents would be in the wrong name as they dont take prints during a traffic stop, and i would imagine that those prints did go into a federal data base and what if this guy wants to but a gun legally he could do so as the name wouldnt be right, and most states dont do fingerprints for a general gun permit, unless the person is asking for a concealed weapons license, see how wrong this can go in a big hurry so i guess if it was me and my conscience id do something about it as i believe all cops would do this off the record so they could get this guy

When it's clear a woman is making a false allegation of domestic violence, should the man be arrested anyway?

Last night I was watching a rerun of COPS and they showed an interesting segment from San Antonio, TX.





The police were called out on a domestic violence call, finding a man sitting outside a house. Entering the house, the male officers found the wife. She had hand shaped bruises on her arms and around her neck. She said he tried to strangle her.





He told the police that he never entered the house or touched her. While handcuffing him, a female officer arrived. She entered the house and spoke to the wife. When she came out, she asked the male officers if they noticed the hand prints were the same size as the woman's own hands, and not the man's?





She next talked to the neighbors, who told her that the wife was the violent and aggressive one, not him.





The problem was, San Antonio had a mandatory arrest law when a woman makes a complaint of domestic violence, so they had to arrest him, anyway.When it's clear a woman is making a false allegation of domestic violence, should the man be arrested anyway?

Something doesn't smell right in this story... Who called the police? Why was the man even there, if he never went in the house and never touched her? It is also possible that the bruises were her own hands, used in defense.





Those laws are in place because, in general, a man is a lot stronger than a woman. And, in general, men are more violent than women.





Also, there's a lot of domestic violence that goes unreported, so when a woman reports it, they HAVE to take it seriously.
The police were correct. they were doing their job. But hat he does is important to his innocence.





He should obtain a report from the police including a statment from the neighbors and the police officers who figured it out.





He should go to full trial and fight it, also he should hire an attorney and file his own TRO.
The female cop was sharp. What you witnessed is a case where 'the law is an ***' and assumes that every complaint is legitimate and every male is guilty. The law needs to be changed. If it happened to me I would consider a lawsuit........and ponder a divorce.

What they failed to mention, was that he could file charges against the police department for false arrest and can also file charges against the one who accused him. So yes he was arrested, but he can get the charges dropped off the public record and he will get his revenge for the false allegations. Many departments have that policy, but they have to have evidence to support the claims. In most cases, if the evidence is not there, they will have one of the parties leave for the night.
Been there, seen that! Almost the same thing happened to my brother when his crazy ex beat her own a**. And he spent a month in jail. Case was dismissed thank god!
A police officer is to act upon evidence he observes at the scene unless the victim presses charges themselves. Now once arrested its up to the DAs office to sort out the facts and crime scene evidence if charges should stick and a case filed into the courts or dismiss the charges based upon lack of evidence to prosecute on.The officers probably arreste him on the facts that something occurred there but that the evidence didnt actually match said allegations so they did probably to preserve the peace and let the DAs office or police detectives sort it all out. I think if two couples are having any heated words, the man should leave and go somewhere. Then the emotional woman can calm herself down. If the man goes back to this woman, then shame on him. And if she did lie about the deal, shame on her. He will be booked into jail, but she has to press charges and go through allot of paperwork and reports, which most couples do not do. We were not there, so if she is a nut case and hits herself... well who knows what really went on there. This sort of case makes the really battered female look bad. It takes two in a relationship, so sounds like this has happened before with this couple.

A month later, 15 illegals were arrested in Roswell. They were there to paint military aircraft, including the C-130. Some were actually painting the aircraft when they were arrested.


In January 2007, ICE arrested two men who were conspiring to hire illegal immigrants to work on Quantico Marine Base in Virginia. One of the men, Juan Martinez, had been deported once already, but re-entered the country illegally again. They arrested “14 undocumented workers were administratively arrested in Virginia, three at the Quantico Marine Base, three in Fredericksburg and eight at the apartment complex in Dumfries.”


ICE also arrested two illegal immigrants at Creech AFB in Indian Springs, Nevada. One of the men was “a member of MS-13, considered to be one of the most dangerous gangs operating in America. “


Twenty-one illegal immigrants were arrested when they tried to enter Fort Benning in January of 2007. They were working on the soldier’s barracks.


The threat to military installations is real. There have been more than enough illegal aliens arrested in connection with our military installations to know that sooner or later someone with enough drive will end up killing someone on a base somewhere

military members are the biggest targets for identity theft. i won't say why in this forum, but their information is stolen and because they have passed a background check it's easier for illegal immigrant to assume their identity and explain discrepancies away. it is a real threat, a serious threat and if it were my decision they would be held as enemy combatants. who knows what they did before they got caught.

Hi, my boyfriend had his aunt and uncle live with us for awhile which didin't work out. while they was moving their last load of things his aunt was sitting on the front porch he went outside and asked her nicely to to get up so he could bring the chairs inside.. she got up and he gently brought it inside, we went to walmart later that night our friend informed us that his aunt marge went to the hospital by ambulance that he yanked the chair from underneath her that her back hurt and her big toe was bruised which she's a diabetic and also has bipolar. if her back hurted so much then why was she helping loading boxes in storage? she also collects social security disability for back pains and bipolar but i don't see how when she's lifting? so he got arrested and has to go back to court. can he get her into trouble for having him falsely arrested?My boyfriend's Aunt marge made false accusations against him and had him falsely arrested? Well if your BF did not yank the chair from his aunt, and causing her to injure her back and toe, then your BF's aunt filed a false police report, which is a crime. Sounds like you need to get a lawyer to fight on your behalf. If you can't afford one, you can have one appointed to you by the court. If what you are saying is true, I think she can be brought up on perjury charges for lying. If there are no witnesses then not much. Get a good lawyer or you will get domestic battery charge upheld and then you are screwed. Major consequences and there things you can never own or jobs you can never get. Counter sue for false arrest and see if she has a history for filing on people to establish pattern. GOOOD LAWYER!
talk to a lawyer ASAP, you may be able to file a counter claim against her..

    Hi i was arrested in aug 12th, because a person i was helping out told a false story to the police and got me arrested. they arrested me without hearing my side of the story.. i was bailed out and awaiting my areinment that was set for oct 6th. well on oct 6th we went to the court house only to find that nothing had been filed against me from the DA at this time. They marked me as showing up, but never gave me another time or date to come back.. what do i do now?? I would like to get this case overwith and clear my name.

    Talk to the DA. They may have decided not to pursue the case and just failed to inform you before the court date. If that is the case, you don't need to do anything else. At the very least, you will then know where you stand. You may wish to be careful what you say so you don't incriminate yourself, but simply asking the status of your case can't be used against you.

    Your situation is all too common in the post -OJ Simpson world we live in. Now, if a woman complains against a man, the cops arrest first, and ask questions later (if they ask questions at all.)





    You will have to hire a lawyer and then defend yourself in court. Your lawyer should hire a private investigator, preferably a female, who can investigate this complaining witness. Maybe she will admit to another woman that this whole thing was a charade to get you out of her apartment.

    Get an attorney. If you cant afford one call and make arraingments for a public defender. You must prove you are not guilty. I suggest you get all the evidence you need and prove your innocence. If she lies under oath then she is committing perjury. If you are found not guilty you could possibly take her to civil court for false accusations. The police most likely believe her or they wouldnt have charged you. Give the judge respect and I suggest not bringing up that she is lying until you prove your innocence. Worry about proving your case first. As for criminal charges against her, I highly doubt it unless you can prove she did it intentionally to harm you. It is her word against yours,and the police are on her side.

Be as truthfull to the judge as you can and a judge can pretty much tell who is telling the truth and who is not. you can find the necessary forms that you will need to answer the complaint against you and your counter claim at your local court house for free. however, they may require a filing fee, if you are indigent or don't make alot of money, ask for a waiver of fee's form and see if the court will allow you to file your case for free. fill out your answer to the complaint against you, and the counter claim, and the waiver of fee;s and file all at the same time. you will know within 2 weeks if the judge will let you file for free. if not file your answer to the plaintiff's complaint and your summons and complaint against the plaintiff at the same time, but remember you have to file these documents within the 20 days of the date you recieved your summons and complaint.
    I am sorry but you totally misunderstand the legal system, you have been charged with a criminal offense ( not a civil issue) you don't counter sue in criminal offence, you need to defend youself and be found not guilty. ( so if you don't have an attorney get one) just because you are not guilty does not mean the judge will not find you guilty)





    Then after you are found not guilty, you can see if the police will go after them for filing a false police report.


    Just being found not guilty does not automaticly mean they will charge her with perjury.





    You can not make them charge anything and most of the time when charges are made if that person is found not guilty nothing happens to the person making the charge.
    Right now, it's your word against hers, unless there is physical evidence that you did injure her, and it was documented, and photographed. If she had an order of protection pryor to your confrontation, you better get a lawyer. If it was obtained afterwards, stay away, or you will be arrested again. Perjury doesn't apply, because that pertains to lying under oath. All the facts will come out in court. If it's proven, the female gave false information to the Police. It would be up to the court as to what the next step would be.
    I believe you would need to discuss this with your attorney. Of course, as for pressing charges, go and speak with the criminal magistrate.

    My ex girl lent me some money, $200 to get stuff outta storage and at a later time she lent me $100 for food and stuff like that.Well we ended up breaking up and i moved out, i didnt pay her back yet so she thought that she was never gonna get her money back so she called the cops and told them that i took her checks, filled them out myself and cashed them without her knowing.A couple of weeks later i was arrested and charged with 2 felony counts of forgery and 1 ct of grand theft.Well she realized that she really screwed me over in the whole thing, now she feels guilty and wants to fess about lying.My question is what charges will she face for making a false police report?     In the past, my brother seemed to be in trouble with the law a lot. Well this time, he was actually innocent. Long story short, a former roommate of his accused him of I.D. theft...that is, he was accused of using his roommate's Name and SSN to get cable. He was arrested (I bailed him out), got a court date, and the charges were dropped...mainly because he simply didn't do it and there wasn't a shred of evidence to prove that he did, but mostly because his roommate claimed never to have lived at that address.     well, good question. what he can do is get the charges against him dropped. he can technically sue the other person for filing a false report, however it is going to be long and difficult to do. also with his past record it may back fire on him.
    Yes he could be arrested but if the system where you are is back logged then they might not want to bother with it. Maybe your brother should take him to small claims court to see if he can get any money for lost wages, bail, defamation of character etc...     I'm not happy about this - they interviewed me, and made it clear that they are going to drop it, and from the start doubted the allegation.

    Get a real lawyer if you are serious. It's the only way to find the solution you are seeking.





    And yes you can get rid of a record with an expungement. Not easy, but it can be done. So disregard the guy below me. Get a -real- lawyer and don't listen to ';top contributors'; on Yahoo! for heaven's sake.
    Don't assume that they're going to drop the charge just because they ';made it clear'; they would. That's a classic interrogation trick. When they interview you, they tell you they believe you to put you off your guard, to try to get you to give them evidence against you.

    There is an old expression: ';she hits you, you go to jail.'; It happens all the time. Some women get crazy memories of tense situations, and lose their grip on the reality of it. So the cops have only one complaint to go on, and they almost always treat an assault allegation from a woman as serious not frivolous. Even if there's no evidence or witnesses. This policy has a lot to do with politics and not wanting to look soft on domestic violence, so when in doubt, they arrest the man.





    That's police policy, and there's nothing you can do about it. Never expect a cop to act against department policy, or to help you avoid a charge. Once they're done collecting all the evidence against you they can find, they'll hand it to the DA and forget about it. If the DA thinks there's a chance they can throw you in jail, they'll try. DA's don't care if someone is guilty, they just care if someone LOOKS guilty, or if they can make someone look guilty.

    Domestic abuse has a sort of rarefied air of guilty-until-proven innocent (as does child abuse and some others). Fortunately we have a court system that provides due process and you will get your day in court. If it is determined that this was an egregiously false report you can sue you ex-wife for the costs required to defend yourself when the trial is all over (in civil court)...and it will not be a plus for her in the custody hearing. I would not under any circumstances plead to a lesser charge just to get over it faster.





    I am sorry about all of this. It is amazing what one partner will do to another...unthinkable really. Persevere - you have children and if you do not, they will grow up thinking how your wife behaves is right and normal.

    If you truly didn't do anything to her or the kids then go to court when you should and take a lawyer with you. It would help to know what state youre in because I live in Wisconsin which is a very progressive state as far as mens/fathers rights go. In Wisconsin it doesn't matter if you are in jail, you still can have visitation and custody. Court and lawyers cost a lot of money however, do you believe that your children are worth it? Most lawyers will work out a monthly payment plan with you and believe me it will be worth it. You can always file charges against her for fleeing the state with no custody placement order from the court.
    I am in Ohio and my ex accused me of abducting her at gun point. This never happened. All she wanted was my son because we have shared custody. I was arrested and 3 years and $20 000 later was I only able to clear it up. Yes, they can do it and you can do nothing about it. It costs upward of $250 an hour for an attorney too. Because abduction was a felony, instead of taking the chance with a jury and getting 5 years, I decieded to take a misdem. plea. I got it expunged, but now the prosecutor who doesn't even know me and who had nothing to do with the original case, wants to over turn my expungement, so now I had to get an appeals lawyer ($3500) to talk to them about it. I am still awaiting the verdict and my ex continues to take me to court for things. She has so far got nothing because we still have joint custody and with all she put me thru', other than losing thousands on something I didn't do everything is still the same as it was when we got divorced and I see my son all the time. I know it sucks that us men can't do anything. I pay her $508 a month for child support and she is still wanting more and keeps taking me to court. So far the court has granted her nothing more. We have another court date on 7/24. It is on going and devastating emotionally and especially financially. Good luck, I know where you coming from. Hang in there and if you did nothing wrong, I feel that it will one day work out for us.
    YOu need to document any and all instances of falsity from your ex, and consider filing a PPO - personal protection order.





    You also need a good lawyer. Talk to the police in your area and ask them about how you can get your record cleared. Believe me - this country preaches ';innocent until proven guilty'; but I have seen that he (or she) who calls the cops first is treated as though they are right. No one checks the facts first to see if the accusing party is lying or not.

    The rest about your kids all depends on what state you reside in. The fact of the matter is that you need a lawyer and lots of money. You can sue for her accusations if you can prove them to be false.





    I'm sorry to day that if you are on a fixed income as student you will not get custody of your children, nor will you be able to afford the costs to even work out partial visitation. The best you can do is either quit school to get a full time job to pay for this, or find a lawyer willing to work for free, or bide your time until you have completed your studies and have a job which will provide enough income to accomplish this.

    The liberal wants the freedom to go where he wants and live how he wants until he is physically violated. Then, he wants the entire justice system and the government to make sure he is protected at any cost to his freedom. He wants the guns taken away and the punishment for the crime committed against him to be greatly increased.





    The conservative wants a system of regulations that make everyone live by the same rules (for everyone's protection, of course) until the point where he violates one of those rules (maybe because the rules are black and white and life is not). Then, his personal freedom has been violated and he wants the justice system and government to back off and give him the freedom he needs to live life as he wishes.     I think it's more of a generalization than a fact. I've also heard it said that if you're under 30 and not a liberal, you have no heart, and if you're over 30 and not a conservative, you have no brain.
    I think a liberal who was mugged would spend countless hours pondering why they were mugged, and trying to cast the blame away from the mugger and onto society in general. The event would not turn them into a conservative, but would rather be a wonderful way of reinforcing their liberalism. They could even testify on behalf of the poor soul who injured them, so that the dear person could have yet another shot at life and reform. A conservative who was arrested would make a big ethical deal of owning up to the fact that they were, in fact, responsible for whatever illegal act they committed. However, a conservative would also most likely spend much money on trying make sure that their name was cleared after the fact, so that nothing would be noted on their permanent record, since that would mean change, and change is bad. An independent party would most likely make the best of the situation either way, make the system work for them, and see that the responsible party (even their own self) was adequately reprimanded, and rehabilitated if necessary. Belief in the system with a healthy helping of questioning and reform is what makes politics and government work.

    first off you have to wonder is it worth it, a lawyer is going to charge you by the hour and unless harm to your person was done while in jail you may not be able to recoup anything other than lawyer fees and an official apology, the way it sounds though was you had a warrant for a fine took care of it after a FTA was issued before the record came through got arrested for it if that was the case remember the jury of your peers are probably your grandparents and may see the case as a waste of their time and then you recoup nothing and you have a lawyer bill to pay to boot.     Yes, if a court makes a mistake and falsly imprisons you, they must 1-reimburse your loss and 2-compensate for more. This is a very serious crime and there are few records in which a victim is falsley accused.

    A friend of mine was arrested for assault, and harrassment, she was going to court for over a year. Doing this time she was trying to get a job and she was hired for one job until they found out about the charges, and all the other jobs wouldn't hire her because of the charges against her.     false arrest is a crime in most states, but to sue you do need proof.
    Yes, she absolutely can. Have her find a good attorney and take a look at that attorney's rates to make sure it'd be worth her while (money-wise) to sue, though. Attorneys are EXPENSIVE (the ones in my firm charge $150 and $250/hour, and that includes everything from a phone call they take from you to time waiting around court for your appearance to begin.)





    I am not an attorney nor do I have experience in criminal litigation, but I would think that if she was found not guilty, she shouldn't be having any problems anymore finding unemployment because of the charges.     Jobs have the right not to hire anyone with a record. She can get it hidden so no one but the law to see it. She would have to go back to court.Write a letter to the judge that was on her case.
    Remember, the person who 'got her arrested' probably didn't go out of their way to make sure she was arrested. It's apart of the police's job, and then the courts can decide.

    This card would be a photo ID, with other identifying information encoded into the card. This Card would positively Identify Legal Citizens to Police, and other Agencies that a person might come into contact with due to illegal actions or activities.


    With today's advances, such a CARD is Possible, and Needed.

    Your friend is a MORON and a criminal. Not only will he be in trouble for using a fake ID, but if he was using it to procure something he is not legally allowed to have (eg. if he is buying alcohol with it) he will be done for that as well. He will be done for misleading a police investigation, giving a false name, and the charges from last time can be re-looked at as it is now clear that he was trying to hide something.     If they were together, then it can be considered they were both committing the crime. However if this case goes to court, it is most likely the other person will be convicted and your friend won't be. However, he will spend a lot of money on legal expenses and this case will screw up his life for the next year or two while he is fighting it. But I'm sure that the police already knew he was unlikely to be convicted when they arrested him. They just arrest everyone involved in a case in hopes of getting a plea bargain. Your friend should talk to his lawyer and offer to testify against the other person in exchange for a lesser charge or maybe even a dismissal of his charge.

    I 'm asking cuz a friend (over 18) has a joint credit card with her mom (cuz after she got laid off, she needed to rebuild her credit history). Anyway, she never used the card, except this once %26amp;she only did it cuz she didn’t have the cash on her at the time. But before she could mail in the payment, her parents saw the transaction history online %26amp; confronted her, threatening to send her to jail for using “their” card. So in the heat of the moment, she got scared %26amp; lied %26amp; said she never used it, that she didn’t even have the card anymore. She's sent in the full payment, but she can’t tell that to her parents (since she denied using the card)


    The facts are this:


    1.) The credit card was/is a joint account, with 2 cards. 1 card is in the name of my friend, the other card is in the name of her mom


    2.) She’s made full payment for the item purchased





    Now, if the parents report the card as stolen/misused, can my friend be arrested and/or prosecuted for credit card fraud or theft??Can a Person be Arrested/Prosecuted for a False Credit Card Theft Report?
    Lying to her parents about it is probably not a crime, but if she lies to the police, then she is cooked, since making a false report is a crime in most places.





    The charge will not be fraud, since the credit card company has lost nothing. It is not theft since she hasn't stolen anything. it would probably be only making a false report if she is stupid enough to do that, which I am guessing she is.





    In her defense, she should make it clear there was extortion involved, since her parents threatened to have her jailed. If she was indeed a joint owner of the card, then she had the right to use it, whether they liked it or not.





    My advice to her is to get in her parents' face and tell them the truth, and remind them she had the legal right since her name was on it, and she paid it off. So, she should tell them, go ahead, have me arrested! When the police discover her name was on the card, that will be the end of that, and they will threaten the parents for making a false charge or report.     Someone else pointed out the card isn't stolen and there's no fraud involved here. Seems like a no-brainer. If this situation were brought to me at work, and I had all the information you've offered here, I'd politely tell the parents there is no crime and refuse to take a report.





    Now, you go on to say that her parents are *planning* to report the card as stolen, not just ';if the parents report...';. Who do they plan on reporting it stolen to? If it's the credit card company, I suspect that's the end of the story. If it's to the police, I suspect that's probably the end of the story, too.





    Again, if they walked in to my office and told me their card was stolen, I'd take the report from them and file it in a cabinet. I do not have the time in my day to try and track down someone who used a ';stolen'; card once, and then evidently paid for whatever was purchased (and eventually, I'd find out that the balance was paid).





    Of course, her parents are going to find out, too, in the same way they found out it *hadn't* been paid when all this started. That's going to be a little difficult for them to understand, I'm sure.

Where I work people ALWAYS think things are fraud and they call back and are like OMG! I did go shopping last week!     Your friend can not be arrested or charged unless she lies to the Police should they get involved. If the Police ask her any questions she should tell the truth. Also, if the parents report the charge as fraud they may have to fill out a sworn affidavit saying they did not make the charge. If your friend signs that form saying she did not make the charge then she can be charged with fraud. The bottom line is that she can lie to her parents all day and be in no trouble, but if she lies to the credit card company or the Police she can get in BIG trouble.

    My bf was arrested the other from work, well he was working. They accused him of violating his probation. Long story short, he has to be 100 feet from his Dad's house. We live on the other side of the freeway. The Cops claim he is living at his Dads. Which isn't true at all. He sometimes gets mail there and that's it. He doesn't go anywhere near there. My real question is how can I get this dropped? Can I sue them for false accusation? Another thing is he had a probation meeting that morning before work and she said nothing of a warrant. He looked online and there was no warrant either.Arrested for false accusations?
    Ummm . . . okay . . . just because your bf might physically live with you does NOT mean that this is where he is supposed to be living. Specifically, when a person goes on probation he has to provide his residential address to the criminal justice system. Obviously the address he provided was his father's address. And the fact that he ';sometimes gets mail there'; kinda supports that theory.





    You can't get anything dropped. You don't have the power to do anything with regard to this case.





    Even if this WAS a false accusation (which it was not), you wouldn't be allowed to sue for something that happened to your bf. Your bf wouldn't be able to sue even in the unlikely event the officers turned out to be mistaken.





    Finally, just because there was no warrant that morning does not mean there was no warrant an hour after he left his probation officer.Arrested for false accusations?
    Actually, it's none of your business and you can't do anything.





    You can't sue anyone... you don't have any rights or authority to sue someone for another person's issues.





    You trying to 'solve' this issue will cause him more problems.





    They don't just arrest someone for violation of probation for 'false accusations'. There are some facts you've either purposely left out of your comments or you don't know the facts.

    He needs a lawyer. Please do not discuss his case on here, it can only hurt him. He should only discuss this with his attorney.





    You asked if you could sue for false accusation. It is unlikely that you could because you weren't the one accused.





    If this is truly a false accusation, then his father's support will help to clear him.

    For crying out loud. He's on probation, do you not think that his probation officer has his address? Did it ever occur to you that maybe he isn't telling them that he's living with you? If he was arrested for what you say, then obviously his probation officer thinks that he lives with his dad. Maybe you need to be asking some questions of the bf rather than jumping to conclusions!
    You can't do anything as it doesn't concern you. Unless he is mentally challenged it's up to him to look into it. If you interfere it will make him look bad and even wimpish. Mind you business and let him deal with the problem. .
    What exactly are they claiming he did to violate his probation? It sounds to me like he was telling his Probation Officer he was still living at home. If that is the case, he was in violation.





    No, you can not sue. A lawsuit would have to be filed by the person who was wronged, not by you.
