If the Duke lacrosse players sue the state for false arrest, are their chances good to win? Explain.?

They should also go for the woman who filed those BS charges against them. It's BS when a woman cries wolf and everyone automatically believes her.If the Duke lacrosse players sue the state for false arrest, are their chances good to win? Explain.?
They sue the state for violating their civil rights. The prosecutor misconduct of this case is so strong that a jury can find in favor of the Plaintiff.If the Duke lacrosse players sue the state for false arrest, are their chances good to win? Explain.?
It's not a false arrest. The state has to react when a citizen files a complaint. I think the parents of these players are going to go after a lot of people. The D.A. for sure, and maybe the university. We'll see.
False arrest, no. But they may have a Federal Civil Rights action against the DA %26amp; anyone else who suppressed exculpatory evidence that was clearly available.
What it all boils down to is, a DA over stepped his authority and there fore he is the one to be held responsible for any hardships put on the Innocent defendants. He abused his authority and should pay dearly for it, it was a crime against all citizens in a large way. especially the 3 young defendants and they and their family's deserve restitution.
I would go after J.Jackson. He offered to pay for the accusers school and fail to offer the 3 boys. I would bet with TAX FREE $$$$$$ also

Duke University and the Woman making the false charges..
They can not sue for false arrest. Because a crime was assumed to be committed a statement was made and the police acted on it. Whether or not the perpatrator(s) were found not guilty or not they can not sue the state because the state thought that a crime was committed. No the state is covered by the Criminal Code. However if there is any sueing it would be against the accuser.
No they probably can't sue for false arrest. An arrest is made based on PROBABLE CAUSE. The victim's statement would lend to probable cause as would any corroborating evidence. A conviction is made when the evidence proves BEYOND A SHADOW OF A DOUBT (which is a much higher standard than probable cause) that they are guilty of the crime. In this case there was enough probable cause to make an arrest, but not enough evidence to prove their guilt beyond a shadow of a doubt.
They won't have to sue for false arrest. They should sue for false charges. They should also sue Nifong for not dropping charges when there was no evidence and the dna tests cleared them.
I don't know if they can sue The State or not but if they can, they should file a lawsuit against the accuser, Al Sharpton and Jessie Jackson.





Al and Jessie were very quick to speak out against the 3 men who were accused before any real investigating was done in the case but where are they now that the 3 men were cleared of all charges because the DNA evidence did not match any of the accused men?





The accuser, Al Sharpton and Jessie Jackson need to go public with an apology to the 3 men!





They probably will not because Al and Jessie only speak out when the situation gives them the attention they always seem to need!





Not once have either of them come out to admit they were wrong about any situation...especially Sharpton.





Remember the Brawley case?





I am not prejudice against any race but Sharpton and Jackson just irritate the hell out of me!





They have claimed several times that they follow in the steps of Martin Luther King...Well I never met Martin Luther King but I respected him and what he stood for and Al and Jessie are no way near a Martin Luther King!





King would never have acted in the way that Al and Jessie act!
No..there chances are not good....they have to prove that they are innocent and that the state had no evidence.





The state had evidence..it was just not good enough and she was not a reliable witness....and by the way


if we allow the accuser to be punished





We need to punish the accusers of Kobe Bryant, Micheal Jackson, and gasp...OJ Simpson.
