Is it a crime to file a false police report or complaint? If so will the person be arrested?

The report against a cop who accused a driver for speeding. The driver complained and the judge considered a false police report.


1. Once it is deemed that the report/complaint was false, for a 1st time offender usually what is the punishment?


2. If it is deemed that the report/complaint was not false can the victim sue the police man?

If it was found to be false on the complaint ( of course depending on the type of complaint ) yes there can be a penalty/ punishment.But if the complaint is to be found true the Driver may need to go the a lawyer to establish a more firm case against the officer in question if he/she plans to sue.Is it a crime to file a false police report or complaint? Yes, it is a crime to file a false police report. However, it is EXTREMELY unlikely that if you file a complaint against said officer that anything will happen for 2 reasons.





1) They cover each other's asses


2) It will be extremely difficult to prove from your perspective (the very little evidence that SHOULD be there would be destroyed or misplaced)

Depends on your state's statutes. In general, if the cop wrote a false report and it is the first time he/she did something like that, then there is possibly just an internal disciplinary action---but you, as the victim can go to an attorny and file a lawsuit---a good lawyer will get you compensation.





If the ticket was deemed not false, then the situation is such that the burden of proof is on the victim, meaning that the victim has to show beyond a doubt that this was a false accusation---no lawsuit would help there....
it is illegal to file a false police report. especially against a police officer. when someone is accused of a traffic violation the police have ways that they track these things (ie - radars) and most of what they do is caught on camera from their cars including the audio. usually you will be charged with a misdemeanor but if its bad enough it can sometimes become a felony. in your case i dont think they would concider it a felony.
yes it is a crime to file a false police report. if the police filed the report, i don't know but a civilian will be charged, I don't know the consequences though
more than likely the person will get a fine. it is possible to get arrested but very unlikely.





And yes if it is not false the victim can sue.
I think that they'd be on probation for a long time, and if the accuser told the truth the police would probably be suspended indefinitely!

Der yes its a crime its wasting police time and they can take it very serious if u own U now u may just get your wrist slapped
yes depending on the seriousness of the crime and if you ruined someone Else's reputation
Yes it is, but it depends they would if they lied about a murder, but something small you mite just get a fine if caught
