False Arrest?

What legal action can be done to someone who lied to the police and on a police report to have you arrested and later the charge was dismissed?False Arrest?
You can file a charge with the police for filing a false report. Start by going down to the station with all the paper work you need and it will be explained to you there. In some cases someone鈥檚 image may be tainted through the filing of a false report and/or the charge may have given them a lot of mental/physical distress, and if they have the money for legal costs, they can sue for compensation, but this doesn't seem to be your case and if it is, you should consult a lawyer.False Arrest?

I don't know what the terminology or tests would be in other jurisdictions, but in Canada we call the civil action ';malicious prosecution';, which is fair game (albeit rarely used successfully) against people who knowingly cause unjustified criminal proceedings to be brought against you.





(There is also a criminal charge that could be brought against the person, indeed.)
The police arrested you, not the complaintant. You can bring cause of action for emotional distress and other damages. If you can prove the informant KNEW the information was false. You should talk to the prosecutor about a criminal complaint regarding the false police report. Even if the prosecutor declines to prosecute, you can still pursue your civil claim . Being arrested and charged is very traumatic, it rates a ';100'; on the stress scale along with death of a child and being a victim of a violent crime. You also might want to seek some short term counseling, because this experience has been shown to trigger Major Depressive Disorder and anxiety attacks.

you need evidence in your favour then you can have that person subpinaed to the court to have them charged for pergery and charge for making a false report to the police aganst you. which you will need the report number





documentation all records relevent with her signiture whe they are blaming you. you will need proof that she lied to the police.
