You're arrested for fatally retaliating during an overly aggressive false arrest?

attempt by an undercover detective. No witnesses. No arrest warrant. No alibi. No criminal.record. No money. Any chance of justice ?You're arrested for fatally retaliating during an overly aggressive false arrest?
You killed a cop and they actually arrested you and didn't shoot you as soon as they saw you..... you are one lucky guy.

I'd buy a lottery ticket if I were you, this could be your day to get the winner.You're arrested for fatally retaliating during an overly aggressive false arrest?
Why did you pick the pro-police-state guy for best answer? The law exists to serve the people, not the people for the law. I'll assume that you are telling the truth about having ';no criminal record'; and that the arrest was ';overly aggressive'; and ';false.';

Report Abuse

There is no crime more urgent to be deterred than official crime. None. I'd rather have one civilian murderer running around loose than one malicious, malfeasant police officer anywhere in my country. After treason, police malfeasance, including the lethal kind, is the most dangerous crime.

Report Abuse

People who can't police right should not be police at all. People who police wrong should be removed from their jobs by the most expedient means, to remove a danger to the citizenry who paid for police protection and got the endangerment, instead.

Report Abuse

You have a good chance of winning a case by pleading self defense.
killed a cop?

your gonna fry..
Okay, let's try to unravel this question...

';You're arrested for fatally retaliating during an overly aggressive false arrest attempt by an undercover detective.';

This equals to charges of resisting arrest and murder of a peace officer. Net worth: negative for you.

';No witnesses.';

This means that you do not have anybody to support your contention that the arrest was ';overly aggressive,'; or that the detective did or did not identify himself. Net worth: Negative for you. The court will likely assume that you did know that you were being lawfully arrested and resisted, causing the detective to use more force.

';No arrest warrant.';

This is not necessary in all cases and your lack of witnesses leaves you without any way to prove that the detective had no right to stop or arrest you. Net worth: Negative for you. The court can assume easily that there was a sufficient probable cause for the detective to be arresting you.

';No alibi.';

Ummmm... What does this mean? No alibi for whom? Net worth: Zero.

';No criminal record.';

We'll assume that you mean your record. Net worth: Positive for you. A lack of a criminal record tends to show a history of abiding by the law, making you a better witness for yourself in court... If you testify. Also, there is a possibility of some kind of mercy from the court for a first offense of any type during sentencing.

';No money.';

This equals a Public Defender as your representation. Net worth: Negative for you. Public defenders work for the county, just like the prosecutor. Unfortunately, there are less Public Defenders than there are Deputy D.A.'s making for a greater case load and less time to develp a good defense for the charges. This is assuming a good P.D., too.

';Any chance of justice?';

For whom? You? Or the peace officer's family? Justice is a reltive term that means different things to different viewpoints. From your viewpoint, I believe you will not recieve the justice that you want. From the viewpoint of the community and the cop's family, anything less than a death penalty would not be justice to them.

Final Analysis: 4 negatives for you, 2 zero sum, 1 positive for you. This equals: Not good for you.
the problem is, it is not up to any one citizen to determine whether an arrest is false or not. It is up to the court.

If you killed a cop, I hope you fry after a jury of 12 convicts you following your fair trial.
Your chances of beating the charge are slim to none. If you had a lot of money to hire a good attorney, you'd probably beat that charge.
It has happened. You are going to need a good lawyer.
